Terms of Service

These terms constitute a legally binding agreement between you and Som Solutions Ltd (trading as SomPay), a company registered in England & Wales. References to "we", "us" or "our" mean Som Solutions Ltd. References to "you" or "your" mean the person using our service.
1. Acceptance of terms
By downloading the SomPay app, creating an account, or using any part of our service, you confirm that you have read, understood and agree to these Terms of Service and our Privacy Policy.
If you are using SomPay on behalf of a business or organisation, you represent that you have authority to bind that entity to these terms, and references to "you" include that entity.
We are regulated by the Financial Conduct Authority (FCA) as a payment institution. FCA registration number: [PLACEHOLDER — insert when available]. You can verify our registration on the FCA register at register.fca.org.uk.
2. Eligibility
To use SomPay you must:
- Be at least 18 years of age
- Be a UK resident with a valid UK address
- Hold a valid UK bank account or payment card in your own name
- Not be subject to any sanctions or restrictions that would prohibit you from using a financial service
- Not have had a SomPay account previously suspended or terminated for breach of these terms
- Provide accurate, complete and up-to-date personal information as required during registration and KYC verification
3. Description of service
SomPay is a mobile application that enables eligible users to send money from the United Kingdom to recipients in:
Somalia
EVC Plus, Zaad, Bank Transfer
Kenya
M-Pesa, Bank Transfer
Ethiopia
Telebirr, Bank Transfer
Transfers are credited to the recipient's mobile wallet or bank account. SomPay acts as the payment institution processing the transfer; it does not hold funds on your behalf beyond the time required to execute the transfer.
We reserve the right to add, modify or remove supported countries, currencies or payout methods at any time, subject to reasonable notice where possible.
SomPay is available as a mobile application on iOS and Android. Certain features may not be available on all devices or operating system versions.
4. User accounts
You must create an account to use SomPay. When creating and maintaining your account, you agree to:
- Provide accurate, current and complete information at registration and keep it up to date
- Keep your password and login credentials confidential and secure
- Not share your account with any other person
- Not create more than one account
- Notify us immediately at support@somsolutions.co.uk if you believe your account has been compromised
- Complete identity verification (KYC) as required by UK anti-money laundering regulations
You are responsible for all activity that occurs under your account, including transactions initiated by anyone who accesses your account with your credentials. We will not be liable for any loss arising from unauthorised use of your account where you have failed to keep your credentials secure.
We may require you to re-verify your identity periodically or where we have reason to believe your information has changed or is inaccurate.
5. Fees and exchange rates
Transfer fee: We charge a single transparent transfer fee on each transaction:

The fee is shown clearly on the review screen before you confirm a transfer. No additional fees are charged by SomPay. However, recipient banks or mobile money providers may charge their own fees for receiving or withdrawing funds; we have no control over these.
Exchange rates: The exchange rate applied to your transfer is set by us and displayed in the app at the time you initiate the transfer. Exchange rates shown on our website are indicative only and may differ from the rate confirmed in the app at the time of your transfer.
The exchange rate is locked when you confirm your transfer. Rates are reviewed and updated periodically and may change between the time you check the rate on our website and the time you confirm a transfer in the app.
6. Transfer limits and processing times
Transfer limits are determined by the level of identity verification completed on your account:

Transfers that meet or exceed your unverified limit will be placed on hold pending completion of identity verification. Held transfers are released automatically once your KYC is approved.
Processing times: SomPay aims to deliver funds to mobile wallets within minutes of transfer confirmation. Bank transfer delivery times may vary between 1–3 business days depending on the receiving institution. Processing times are estimates and not guaranteed. Delays may occur due to:
- Additional compliance checks required on a transaction
- Technical issues with the receiving mobile money network or bank
- Public holidays in the destination country
- Incorrect or incomplete recipient details provided by you
We will notify you by push notification and email of the status of your transfer.
7. Prohibited uses
You must not use SomPay to:
- Launder money or finance terrorism, in violation of the Proceeds of Crime Act 2002, the Terrorism Act 2000 or any other applicable law
- Evade sanctions imposed by the UK Government, United Nations, European Union or any other applicable authority
- Commit or facilitate fraud, including but not limited to payment fraud, identity fraud or romance fraud
- Send money on behalf of a third party without their knowledge or consent
- Provide false, misleading or incomplete information at any point during registration, KYC, or when initiating a transfer
- Use another person's payment card, bank account or identity without their explicit authorisation
- Conduct transactions that you know or suspect to be connected to criminal activity
- Attempt to circumvent, disable or interfere with security features of the app or our systems
- Use the service for any commercial purpose other than sending personal remittances, without our prior written consent
- Engage in any activity that violates applicable laws or regulations in the United Kingdom or the destination country
We are required by law to file Suspicious Activity Reports (SARs) with the National Crime Agency (NCA) where we have knowledge or suspicion of money laundering or terrorist financing. We are prohibited by law from informing you if we have made such a report ("tipping off").
8. Cancellation and refund policy
Before confirmation: You may review and amend all transfer details on the review screen before submitting. Once you confirm a transfer, the instruction is processed immediately.
After confirmation: Due to the real-time nature of mobile money transfers, cancellation after confirmation is generally not possible once funds have been sent to the recipient's wallet or bank account.
However, you have the right to cancel a transfer without charge within 30 minutes of confirmation, provided the funds have not yet been paid out to the recipient. To request a cancellation, contact us immediately at support@somsolutions.co.uk or via the app.
Refunds: Where a transfer fails due to incorrect recipient details, network failure or any cause not attributable to you, we will refund the full transfer amount including any fee to your original payment method within 3–5 business days.
Where a transfer fails due to information you provided being incorrect or incomplete (e.g. wrong mobile number), we will endeavour to recover the funds and refund them to you. A recovery fee may apply if third-party costs are incurred. We cannot guarantee recovery in all cases.
9. Intellectual property
The SomPay name, logo, app design, website, content, and all related intellectual property are owned by or licensed to Som Solutions Ltd and are protected by UK and international copyright, trade mark and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the SomPay app on your personal device for the sole purpose of using the service in accordance with these terms. You must not:
- Copy, modify, distribute or create derivative works from any part of the app or website
- Reverse-engineer, decompile or disassemble the app
- Use our brand, name or logo without our prior written consent
- Remove any copyright, trade mark or other proprietary notices from the app or website
10. Limitation of liability
To the fullest extent permitted by applicable law, Som Solutions Ltd shall not be liable for:
- Any indirect, incidental, special, consequential or punitive loss
- Loss of profit, revenue, business, data or goodwill
- Delays caused by third-party networks, mobile money operators or banks
- Losses arising from inaccurate or incomplete recipient details provided by you
- Losses arising from your failure to keep your account credentials secure
- Service interruptions due to maintenance, technical failures or circumstances beyond our reasonable control (force majeure)
Our total aggregate liability to you arising out of or in connection with these terms or your use of the service shall not exceed the greater of: (a) the total fees paid by you to SomPay in the 12 months preceding the event giving rise to the claim, or (b) £100.
11. Indemnification
You agree to indemnify, defend and hold harmless Som Solutions Ltd, its directors, employees and agents from and against any claims, damages, losses, costs and expenses (including reasonable legal fees) arising out of or in connection with:
- Your breach of these terms
- Your violation of any applicable law or regulation
- Inaccurate or fraudulent information you provided to us
- Your use of the service in a prohibited or unlawful manner
12. Third-party services
SomPay relies on third-party service providers to deliver certain parts of the service, including payment processing (Stripe), identity verification (Onfido) and mobile money payout networks. Your use of the service is subject to the terms and policies of these providers where applicable.
We are not responsible for the availability, accuracy or reliability of third-party services. We will endeavour to notify you of significant disruptions but cannot guarantee uninterrupted service.
Our website may contain links to third-party websites. These are provided for information only. We do not endorse and are not responsible for the content of any linked third-party site.
13. Changes to these terms
We may update these Terms of Service from time to time. When we make material changes, we will notify you by:
- Email to the address registered on your account
- In-app notification
- Updating the "Last updated" date at the top of this page
We will give you at least 30 days' notice of material changes before they take effect, except where changes are required immediately by applicable law or regulation.
Your continued use of SomPay after the effective date of any changes constitutes your acceptance of the revised terms. If you do not agree to the changes, you must stop using the service and may close your account by contacting us.
14. Termination
By you: You may close your account at any time by contacting us at support@somsolutions.co.uk. Closure will take effect once any pending transfers have been completed.
By us: We may suspend or terminate your account at any time, with or without notice, if we have reason to believe:
- You have breached these terms
- Your account has been used for fraudulent, unlawful or prohibited purposes
- We are required to do so by law, court order or regulatory authority
- Continuing to provide the service to you creates a legal or regulatory risk for us
On termination, your right to use the service ceases immediately. We will retain your data for the periods required by law as set out in our Privacy Policy.
15. Governing law and disputes
These Terms of Service are governed by and construed in accordance with the laws of England and Wales. You and we both agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these terms or your use of the service.
Complaints: If you have a complaint about the service, please contact us first at support@somsolutions.co.uk. We will acknowledge your complaint within 3 business days and aim to resolve it within 15 business days.

16. General
Entire agreement: These terms, together with our Privacy Policy and any other policies or notices referenced herein, constitute the entire agreement between you and Som Solutions Ltd regarding the service and supersede all prior agreements.
Severability: If any provision of these terms is found to be unlawful, void or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
No waiver: Our failure to enforce any right or provision of these terms shall not constitute a waiver of such right or provision.
Assignment: You may not assign or transfer your rights or obligations under these terms without our prior written consent. We may assign our rights to any affiliate or successor entity.
